The Alabama Home Builder Protection Law
The Legislature has passed a law that tells people who they can hire to do work on their home.
Are we a free people? Yes. We are free to do that which the laws made by our
government on every level (neighborhood, city, county, state, national) allows
us to do.
The term free is subjective, it means different things to different people.
Man's law are always designed to benefit one group over another, so man's law is
never fair and equitable to all man. Nor can it be because man is fallible,
selfish and corruptible.
Our country's law (the Constitution) was based on a higher authority - God's
law. Man's wisdom is God's foolishness. His ways are higher than man's ways, His
thoughts are higher than man's thoughts. God's law is fair and equitable to all
men.
Some examples of man's unfair and inequitable laws are hate crime laws,
discrimination laws, the Americans with disability act, and many more. These
laws are designed to benefit certain groups of Americans and not ALL Americans.
We've recently had a law passed in Alabama that protects Home Builders. This
year in 2011 The State of Alabama passed a law requiring all the Alabama
citizens who want or need work on their home that will exceed $10,000 MUST, MUST
hire a licensed Home Builder.
This work includes ANY work on your home, be it a new roof, kitchen remodel
or an addition. There are many licensed contractors that have been doing this
type of work for years and at a cost that would be much less expensive than what
a Home Builder would charge.
The main purpose of this law is to prop up Home Builders and help them make
money at the expense of other licensed contractors. It is disguised as
"protecting" the home owner from unqualified contractors, but my
question is who will protect the home owner from unscrupulous Home Builders?
It's also important to note that Home Builders do not build homes.
They hire sub-contractors that do the actual building of the home.
I've worked on many new home building projects and I may have seen the Home Builder on site maybe twice during the actual building of the house.
So how is having the Home Builder's name on the permit going to ensure you good work when the Home Builder is simply going to hire someone who does not have a Home Builder license to do the actual work unsupervised?
The bottom line is that the Licensed Home Builder that our State government is forcing you to hire, will get the contract and your money and then hire the contractor that you WOULD HAVE hired to do the work - to do the work.
This is a lot like paying protection money to the mob to protect you from them burning down your house.
You're not going to gain one thing more than before this law, but you can bet that the work is going to cost you a lot more than it would have.
You can find numerous complaints against licensed Home Builders on the Web. Licensed
Home Builders are men same as any other and they will cheat you as quickly as
those they claim to want to protect you from - licensed contractors.
I've been a contractor in Montgomery for 16 years and I can tell you there
are a lot of bad Home Builders in the Montgomery area. But you never hear about
them because the local media like the State Legislature, are in the back pockets
of the Home Builders.
Our State government has decided that you are not capable of making the right
decision as to who to hire to do work on your home. So they have made that
decision for you.
You are NOT FREE to decide who works on your home. But here again the word
free is subjective. Our government will say that you ARE FREE to decide. But you
MUST decide on one of those that THEY have decided can work on your home.
The Alabama State Legislature is picking winners and losers through corrupt laws.
It's nothing more than one group influencing law by some means,
perhaps through political contributions or a deposit in an
off-shore account. Who knows, but what we do know is that our government is denying
people's right to choose.
